Seller's and Buyer's Agreement
Whitaker’s Way Kennels guarantees that puppies are healthy
at time of sale only, subject to the conditions herein. It is mutually agreed and understood by the purchaser and seller that
other than the aforementioned guaranty, the seller makes no warranties, expressed or implied concerning the conditions of
any puppy sold. Buyer waives any right buyer may have to demand, as against seller, a recession or resolution of this sale,
or a reduction of the purchase price, or replacement of the puppy/puppies after the sale unless the following conditions are
complied with.
1.
Puppy/puppies must be examined
by a licensed veterinarian within 48 hours after purchase at purchaser’s expense. Seller is not responsible for the
death of a puppy/puppies due to hypoglycemia, corona, and parvo, because these are high risk elements in the air and can be
contracted at any time pet is in transit by the buyer.
2. If the purchaser’s veterinarian finds cause for return of the puppy/puppies
for life threatening health issues, seller must be notified within 48 hours of the purchase. Seller is only responsible for
the veterinarian fees of the seller’s personal veterinarian.
3. Provided both the seller’s and purchaser’s veterinarian agree that
there is reasonable cause for the return of the puppy/puppies due to health issues which existed at the
time of the purchase, and further provided that the puppy/puppies has been properly cared for in the purchaser’s possession,
seller will replace the puppy/puppies. No cash refunds.
4. Buyer must provide a statement by a veterinarian identifying the health risk
including a description of the symptoms. If the buyer qualifies for a replacement puppy, the buyer can choose a new puppy
with a retail value equal to the cost of the original puppy/puppies. Any shipment fees involved must be handled by the buyer.
BUYER’S
AGREEMENT: The buyer understands that puppies are sold as pets only and there is no guarantee of size,
color, quality, or fertility. The buyer agrees that he/she has read and understands this contract fully and agrees to pay
any and all legal cost should arise. The buyer holds the seller harmless for any claims, trauma, damages, and/or expenses
of any kind. The buyer understands that this contract is under the jurisdiction of the state of Louisiana, and the parish
of Ouachita, and that should the need arise, place of venue should be in Ouachita Parish, Louisiana.
